Terms of Service

Welcome to Komachi. These Terms of Service ("Terms") govern your use of the Komachi mobile application ("App") operated by Gajami ("we," "us," or "our"). By creating an account or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 18 years old to use Komachi. By creating an account, you represent and warrant that you are 18 years of age or older. Accounts found to belong to users under 18 will be terminated immediately.

2. AI Character Disclaimer

• Character interactions are powered by artificial intelligence (Large Language Models).
• AI responses may be inaccurate, inconsistent, or inappropriate despite our moderation efforts.
• Komachi is an entertainment service and should not be used as a substitute for real human relationships, professional counseling, or medical advice.
• We do not guarantee the accuracy, reliability, or appropriateness of any AI-generated content.

3. Account Registration and Security

• You must provide accurate and complete information when creating your account.
• Each person may maintain only one account.
• You are responsible for maintaining the confidentiality of your login credentials.
• You must notify us promptly if you suspect unauthorized access to your account.
• You are responsible for all activity that occurs under your account.

4. User Conduct

When using Komachi, you agree not to:

• Use the App for any illegal purpose or in violation of applicable laws.
• Attempt to exploit, hack, reverse-engineer, or decompile any part of the App.
• Use automated tools, bots, or scripts to interact with the App.
• Attempt to extract, scrape, or harvest AI model data or character information.
• Impersonate another person or misrepresent your identity.
• Share your account credentials with others.
• Create multiple accounts.
• Upload content that is unlawful, harmful, threatening, abusive, defamatory, or otherwise objectionable.
• Interfere with or disrupt the App's infrastructure or other users' experience.

5. Intellectual Property

• All AI characters, their images, profiles, bios, and generated responses are the intellectual property of Gajami.
• You may not reproduce, distribute, modify, or create derivative works from any AI character content without our prior written consent.
• You retain ownership of the content you create (profile information, chat messages). By using the App, you grant us a non-exclusive, worldwide, royalty-free license to use such content solely for the purpose of operating and improving the service.

6. Subscriptions and Payments

• Komachi offers three subscription tiers: Free, Gold, and Platinum. Pricing is displayed in the App and may vary by region.
• Subscriptions are billed through the Apple App Store or Google Play Store. All payment processing is handled by the respective app store.
• Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current billing period.
• To cancel, manage your subscription through your device's App Store or Play Store settings.
• In-app purchases (such as Superlikes) are non-refundable except as required by applicable law or the respective app store's refund policy.
• Free-tier users will see advertisements within the App.

7. Advertising

Free-tier users will see banner and rewarded advertisements provided by Google AdMob. Advertising content is supplied by third parties, and we do not endorse or guarantee any products or services advertised. You may remove ads by subscribing to a paid tier.

8. Content Moderation

We reserve the right to review, moderate, and remove any user-submitted content that violates these Terms or applicable law, without prior notice. We also employ AI-based content moderation to maintain a safe environment.

9. Service Availability

• Komachi is provided on an "as is" and "as available" basis.
• We reserve the right to modify, suspend, or discontinue any part of the App at any time, with or without notice.
• We do not guarantee uninterrupted, error-free, or secure access to the App.
• Scheduled maintenance or unforeseen technical issues may temporarily affect availability.

10. Limitation of Liability

To the maximum extent permitted by applicable law:

• Gajami and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App.
• Our maximum aggregate liability for any claim related to the App shall not exceed the total amount you paid to us in the 12 months preceding the claim.
• We are not liable for AI-generated content, including responses that may be inaccurate, offensive, or harmful.
• We are not liable for any actions or omissions of third-party service providers (Google AdMob, RevenueCat, OpenRouter, etc.).

11. Indemnification

You agree to indemnify, defend, and hold harmless Gajami and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the App, your violation of these Terms, or your violation of any third-party rights.

12. Account Termination

• You may delete your account at any time through the App's profile settings.
• We reserve the right to suspend or terminate your account if you violate these Terms, without prior notice.
• Upon termination, your data will be handled in accordance with our Privacy Policy.
• Active subscriptions should be cancelled through the App Store or Play Store before deleting your account to avoid continued billing.

13. Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Republic of Korea. Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of the Republic of Korea.

However, if you reside in a jurisdiction with consumer protection laws that cannot be waived by contract, those local laws apply to the extent required. Nothing in these Terms limits your rights under such mandatory local laws.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

15. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you through the App or via email. Your continued use of the App after changes take effect constitutes acceptance of the updated Terms.
